Terms and Conditions
1. Introduction
1.1. These terms and conditions (the “Terms”) govern your use of the GoGrab mobile application (“App”) and the services provided through it (“Purchase Services”). By registering, using, browsing, and/or reading the App, you accept and agree to be bound by these Terms. If you do not agree with these Terms, you must cease usage of the App immediately.
1.2. The App is operated by Tasty Tech Pty Ltd, an Australian company registered under ACN 666 589 699 (“Tasty Tech”). Access to and use of the App, or any of its associated products or Purchase Services, is provided by Tasty Tech.
2. About the App
2.1. Welcome to GoGrab! The App is a mobile platform through which you can browse and purchase Variety Bags containing a random assortment of surplus food from the vendor. The App facilitates this service by granting you access to the Variety Bags on the App. GoGrab does not produce, handle, supply, or sell the Variety Bags or the surplus food within them.
3. Acceptance of Terms
3.1. Please read these terms and conditions (the ‘Terms’) carefully. You accept the Terms (including any applicable charges) by registering, using, browsing, and/or reading the App. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by GoGrab in the user interface.
3.2. If you do not agree with the Terms, you must cease usage of the App, or any of its Purchase Services, immediately.
3.3. GoGrab reserves the right to review and change any of the Terms by updating this page at its sole discretion. When GoGrab updates the Terms, it will use reasonable endeavors to provide you with notice of updates to the Terms.
3.4. Any changes to the Terms take immediate effect from the date of their publication and will apply for the duration of your use of the App or until termination in accordance with clause 12. Your continued use of the App following the publication of those changes to the Terms will be deemed your acceptance of those changes. Every time you use the App, it is your responsibility to be aware of our current terms. Before you continue, we recommend you keep a copy of the Terms for your records.
4. Registration to use the Purchase Services
4.1. In order to access the Purchase Services, you must first register as a user of the App. As an unregistered user, you are able to browse and find Vendor Partners’ profiles on the App. You may not use one email address to register for multiple accounts.
4.2. As part of the registration process, or as part of your continued use of the Purchase Services, you may be required to provide personal information about yourself (such as identification or contact details), including:
- Full name
- Mobile number
- Email address
4.3. Registered Users have access to the Purchase Services and are able to:
- Search and find Vendor Partners’ profiles on the App
- View the listed Variety Bags available for sale from the Vendor Partners and the associated discounted prices
- Place an order for Variety Bags listed by a Vendor Partner
- Pay for their order via credit card through Stripe
- Access their purchase history and receipts
- Contact GoGrab support directly
4.4. GoGrab does not guarantee the accuracy or completeness of any information on the App or otherwise provided to users. This includes the Vendor Partners’ and/or Registered Users’ (or their Variety Bags) identity verification, credibility, capacity, ability, or willingness to transact with you. You agree that it is your responsibility to make inquiries as to the accuracy or completeness of any information.
4.5. Any hyperlinks or banners linking to other websites on the App are not subject to our control or privacy standards, policies, and procedures, and therefore, we are not responsible for the content and other practices associated with such linked websites. Accordingly, we suggest that you check as to the relevant policies of those third parties.
4.6. GoGrab does not take any responsibility for any damage to your computer systems that may arise in connection with your access to and use of the App.
4.7. You warrant that any information you give to the App in the course of completing the registration process (‘Registration Information’) will always be accurate, correct, and up to date.
4.8. You consent to the following:
- We may provide Registration Information to Vendor Partners and/or Registered Users for the purposes of providing you with Purchase Services
- You may receive emails and/or push notifications from us regarding your registration and orders or other third-party products and services that may be of interest to you determined by us
4.9. Once you have completed the registration process, you will be a registered member of the App (‘Registered User’) and agree to be bound by the Terms. As a Registered User, you will be granted immediate access to the Purchase Services.
4.10. You may not use the Purchase Services and may not accept the Terms if:
- You are not of legal age to form a binding contract with GoGrab
- You are a person barred from receiving the Purchase Services under the laws of Australia or other countries including the country in which you are a resident or from which you use the Purchase Services
4.11. GoGrab reserves the right to take legal action and seek compensation from a parent or guardian of a person under legal age for any loss or damage we may suffer as a result of, or in connection with, any transaction entered into on, or via the App by that person.
4.12. As a Registered User, you agree to comply with the following:
- You will use the Purchase Services only for purposes that are permitted by the Terms, any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions
- You have the sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Purchase Services
- Any use of your registration information by any other person or third parties is strictly prohibited. You agree to immediately notify GoGrab of any unauthorized use of your password or email address or any breach of security of which you have become aware
- Access and use of the App is limited, non-transferable, and allows for the sole use of the App by you for the purposes of GoGrab providing the Purchase Services
- You will not use the Purchase Services or App for any illegal and/or unauthorized use which includes engaging in any activity that is malicious or technologically harmful, collecting email addresses of Registered Users by electronic
5. Purchase of Variety Bags
5.1. Registered Users may order Variety Bags listed on the App for sale by Vendor Partners.
5.2. When placing an order for a Variety Bag through the App, you are offering to purchase the Variety Bag for the price listed at the time of purchase, subject to these Terms.
5.3. To place an order, you must follow the prompts on the App to select the desired Variety Bag, quantity, and any other relevant details, and then proceed to payment.
5.4. Payment must be made in full at the time of placing the order. Payment can be made via credit card through Stripe.
5.5. Once payment is received, GoGrab will provide you with confirmation of the order and issue a receipt for the transaction.
5.6. GoGrab reserves the right to refuse or cancel an order for any reason, including but not limited to unavailability of the Variety Bag, errors in the description or price of the Variety Bag, or error in your order. In the event of a cancellation, GoGrab will refund any payment received for the order in full.
6. Pick-Up of Variety Bags
6.1. Variety Bags purchased through the App will be available for pick-up by the customer from the Vendor Partner’s location.
6.2. The pick-up process, including but not limited to the timing, location, and any additional instructions, will be determined by the Vendor Partner and communicated to you at the time of purchase.
6.3. GoGrab does not guarantee the availability, accuracy, or reliability of the pick-up process provided by Vendor Partners. Any issues or disputes relating to pick-up should be directed to the relevant Vendor Partner.
7. Copyright and Intellectual Property
7.1. The GoGrab App, including all associated products and services, is protected by copyright laws. All rights to the content within the App, including text, graphics, logos, button icons, images, audio clips, and software, are owned or controlled by GoGrab and its contributors.
7.2. GoGrab retains all rights, title, and interest in the App and its related content. Users are not granted any rights to the business name, domain name, trademark, copyright, or any other intellectual property owned by GoGrab.
7.3. Users may not reproduce, display, perform, broadcast, republish, upload, transmit, post, distribute, or modify any content within the App without prior written permission from GoGrab.
7.4. By uploading, posting, or transmitting any material through the App, users grant GoGrab a non-exclusive, royalty-free license to use, publish, reproduce, and exploit the material for any purpose. Users represent and warrant that they have the necessary rights to grant this license.
8. Force Majeure
GoGrab will not be liable for any failure or delay in providing services due to events beyond its reasonable control, including but not limited to acts of nature, government restrictions, and technical failures.
9. Privacy
GoGrab respects user privacy and handles personal information in accordance with its Privacy Policy, available within the App.
10. General Disclaimer
10.1. GoGrab does not make any guarantees or warranties regarding the Variety Bags sold through the App, except as provided in these terms.
10.2. GoGrab endeavours to ensure that Variety Bags are accurately depicted on the App, but variations may occur.
10.3. GoGrab is not liable for any special, indirect, or consequential loss or damage arising from the use of the App or its services.
11. Limitation of Liability
11.1. GoGrab ‘s total liability for any claim arising from the use of the App or its services is limited to the purchase price paid for the Variety Bags.
11.2. GoGrab is not liable for any indirect, incidental, or consequential damages, including loss of profit or goodwill.
12. Termination of Contract
12.1. These terms will remain in effect until terminated by either the user or GoGrab.
12.2. GoGrab may terminate the agreement if the user breaches these terms or if continued service provision is no longer viable.
13. Indemnity
Users agree to indemnify and hold GoGrab harmless from any claims, liabilities, or expenses arising from their use of the App or violation of these terms.
14. Dispute Resolution
14.1. In the event of a dispute, users must notify GoGrab and attempt to resolve the issue through negotiation or mediation.
14.2. If mediation is unsuccessful, disputes will be resolved in the courts of South Australia, Australia.
15. Governing Law
These terms are governed by the laws of South Australia, Australia.
16. Independent Legal Advice
Both parties confirm that these terms are fair and reasonable, having had the opportunity to obtain independent legal advice.
17. Severance
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
18. General Provisions
18.1. Any references to singular terms include the plural, and vice versa.
18.2. Paragraph headings are for reference purposes only.
18.3. Users may not assign their rights under these terms without GoGrab ‘s prior written consent.
